  1. Introduction

    By using My Boat, you acknowledge the following and agree to be bound by these Terms and Conditions of Use.

  2. My Boat content – limitations

    Whilst the Australian Maritime Safety Authority (AMSA) takes all reasonable care in preparing and maintaining the information generated by the My Boat application, it does not warrant the accuracy, reliability, adequacy or completeness of any content in, or information produced by, the My Boat application for any purpose.

    The My Boat application may not be applicable to your specific circumstances. Information provided within the My Boat application may be in the form of summaries and generalisations - it may omit detail that could be significant in a particular context or in relation to your skills, qualifications or operations.

    As the My Boat application is general in nature, it is made available on the understanding that AMSA is not thereby engaged in rendering professional advice or services. It is your responsibility to seek appropriate independent professional advice prior to relying on, or entering into any commitment based on information produced by the My Boat application. In addition, AMSA is not bound in any capacity by any results generated by the My Boat application.

    The My Boat application content is subject to change at any time without notice and may not be up to date or accurate at the time you view it.

    Use of the My Boat application does not remove or override any obligation that may be imposed on you by the Marine Safety (Domestic Commercial Vessel) National Law Act 2012.

    AMSA retains the right to withdraw the My Boat application temporarily or permanently and without notice.

  3. Liability

    To the maximum extent permitted by law AMSA excludes completely all liability whatsoever for any loss or damage of any kind (including special, indirect or consequential loss and including loss of business profits) however caused (including negligence) arising out of or in connection with the My Boat application and the use or performance of the My Boat application, including if the My Boat application is unavailable for any reason.

    Where the law implies a warranty into these Terms and Conditions of Use which may not lawfully be excluded, AMSA's liability for breach of such a warranty shall be limited to supplying the services again.

  5. Jurisdiction

    These Terms and Conditions of Use are governed by and construed in accordance with the law of the Australian Capital Territory. In the event that a dispute arises from these Terms and Conditions of Use, you agree to submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory.
